A junior registrant is a junior user of a trademark who registers the trademark prior to the senior user. Even though the senior user has priority to the trademark, the junior user obtains trademark rights. By becoming the first party to register the mark, the junior registrant can restrict the senior user’s mark usage. For example, the senior user may incur restrictions restricted to a geographic region, determined as of the junior registrant’s filing date. The junior user can utilize a concurrent use application to determine the scope of trademark protection.
